NMsize is an online marketplace connecting fashion creators with customers looking for custom-fit fashion items. These Terms and Conditions govern your use of NMsize, ensuring a secure and transparent experience for both creator and customers.
On NMsize, fashion creators are also referred to as creators, sellers or vendors. Our aim is to ensure a positive shopping experience, so please read this policy carefully to understand your rights and responsibilities as a creator.
This policy is a part of our Terms of Use. By navigating, listing and selling on NMsize, you agree to this policy and our Terms of Use.

I. WHAT CAN BE SOLD ON NMSIZE
NMsize is a unique marketplace where customers look for inspiration and distinctive custom-made fashion items. Therefore, every product listed on NMsize must be custom-made, designed, or carefully selected by a creator.
As a creator on NMsize, you are required to provide the following details for each item:
- Accurate Representation: Describe how the item was made and who was involved in its creation.
- Shop Information: Provide a detailed description of any team members involved in making your items or managing your shop in the About section.
- Production Partners: If you use a production partner, disclose this information in your relevant listings. For more details, read about working with production partners.
- Original Media: Use your own photos or videos — not stock images, artistic renderings, or photos from other creators or sites. For specific image requirements, including exceptions for custom items and production partner assistance, refer to our listing image guidelines.
- Artificial Intelligence Disclosure: If an item involves artificial intelligence in its creation, disclose this in your listings. Learn more about our policies on AI creations here.

We encourage you to be transparent about the crafting process and the origins of your materials. You can mention any social or environmental attributes, such as being organic or recycled, and specify the location of manufacture.
II. WHAT CANNOT BE SOLD ON NMSIZE
Even if items otherwise meet our marketplace criteria, NMsize prohibits the sale of certain items, services, and items that infringe on intellectual property rights.
All listings must offer a tangible product for sale, including digital items and reserved listings for custom orders. Listings created solely for purposes such as posting want ads, crowdfunding, or similar activities that do not offer a physical or digital product are not allowed.
Dropshipping and reselling are not permitted on NMsize, except for specific cases detailed in our guidelines, such as craft supplies.
NMsize reserves the right to remove any listings that violate our policies. We use automated systems, manual monitoring, and reports from members and third parties to identify policy violations. Note that account suspension or termination may occur for policy violations, and any outstanding fees must still be settled.
III. MANAGING YOUR STORE
Your store reflects you and your business to the NMsize community. It is crucial that you, your items, and your store are represented honestly and accurately.
By selling on NMsize, you agree to:
- Provide honest and accurate information to NMsize and in your About section.
- Adhere to your Store Policies.
- Ensure that your store content, including any text, photos, or videos used to represent yourself, your store, or your listings, complies with NMsize’s policies, including our Anti-Discrimination Policy.
- Accurately represent your items, including details about the country of origin, provenance, attributes, components, or materials, in listings and listing photos.
- Respect the intellectual property rights of others. If you believe someone has infringed on your intellectual property, you can report it to NMsize.
- Avoid facilitating off-platform transactions.
- Refrain from creating duplicate stores or taking any actions (such as manipulating clicks, carts, or sales) aimed at manipulating search results or circumventing NMsize’s policies.
- Not coordinate pricing with other creators.
IV. CREATOR STANDARDS
By listing a product for sale on NMsize, you understand and agree that you are responsible for complying with all applicable laws and regulations for the products you list, including any required labels and warnings. NMsize assumes no responsibility for the accuracy, labeling, or content of your listings.
By selling on NMsize, you agree to:
- Honor your shipping and processing times. Creators are required to ship items or otherwise complete transactions with customers promptly, unless exceptional circumstances arise. Note that legal requirements for shipping times may vary by country. For more information, see our Shipping Policy.
- Respond to messages in a timely manner.
- Adhere to the commitments made in your store policies.
- Resolve any disagreements or order issues directly with the customer.
- If you are unable to complete an order, you must notify the customer and cancel the order.
V. PRICING AND TAX
As a seller on NMSIZE, you are solely responsible for managing all aspects of taxes in accordance with applicable tax regulations. This includes, but is not limited to, the following obligations:
Collecting Taxes: You must collect the appropriate taxes from customers based on their location and the relevant tax rates.
Including Tax in Pricing: Ensure that your item prices include any applicable tax. The final price displayed to the customer should be tax-inclusive, so no additional tax charges are applied at checkout.
Remitting Taxes: After collecting the required taxes, you are responsible for remitting it directly to the appropriate tax authorities in your jurisdiction, in compliance with local tax laws.
NMsize does not manage or remit taxes on your behalf, and you are expected to comply with all local, state, and federal tax obligations.
Invoicing Responsibility: As a creator, you are responsible for generating and providing invoices to your customers in compliance with applicable tax laws and regulations. This includes ensuring that all required information is clearly presented on the invoice, such as product details, the total price, and any applicable taxes.
VI. SELLING FEES
NMsize ensures that all financial transactions conducted on the platform are processed securely and in compliance with industry standards. The marketplace operates on a commission-based revenue model, where NMsize retains a commission of fifteen percent (15%) from each completed sale. This commission is automatically deducted at the point of sale and represents the only fees associated with sales on NMsize.
Listing products on NMsize is free. Each creator can list up to 100 items at no cost and for an unlimited duration.
Creators also have the option to enhance the visibility of their products through our paid advertising feature. For a fee of $5.90 per product, creators can promote their listings for seven (7) days. Advertised products benefit from priority placement on the platform, including prominent display on the homepage and elevated ranking at the top of relevant product listings.
All fees and charges are clearly communicated, and there are no hidden fees.
VII. SHIPPING
As a Fashion Creator on NMsize, you are responsible for managing the shipping process of your products, ensuring compliance with all legal and logistical obligations. By using NMsize’s platform, you agree to the following shipping terms:
Shipping Responsibility: You must properly package, label, and ship items to the Customer’s designated address. You are responsible for the items until they are delivered to the Customer. NMsize is not liable for any issues that may arise during transit, including delays, damages, or loss.
Transport Insurance: We strongly recommend that you use transport insurance for each shipment to protect against potential loss or damage during transit. The choice of insurance and carrier is your responsibility, and NMsize bears no responsibility for any issues that occur after the items leave your possession.
Authorized Shipping Destinations: You must ensure that you are legally authorized to sell and ship goods to the selected countries. You must also comply with all local regulations, export restrictions, import duties, and customs requirements applicable to each destination. Failure to adhere to these regulations may result in account suspension or termination.
Invoices and Tax Requirements: You are required to include an invoice with each shipment. The invoice must clearly reflect the total amount paid by the Customer, including a detailed breakdown of taxes and fees. Accurate invoicing ensures compliance with local tax laws and avoids potential disputes.
Delivery Timeframes: You must provide realistic and transparent delivery timeframes for each order. If any delays occur, you are obligated to notify the Customer immediately and provide an updated delivery estimate. Frequent or unjustified delays may result in policy violations and potential account restrictions.
Shipping Confirmation and Tracking: You must provide shipping confirmation and tracking information to the Customer upon dispatch. This information must be accurate and reflect the current status of the shipment. Maintaining accurate shipping records is essential for resolving disputes related to delivery.
Shipping Costs: You are responsible for determining and setting accurate shipping costs for each item. Misrepresentation of shipping costs or failure to deliver items as promised may result in penalties under NMsize’s policies.
Lost, Damaged, or Misdelivered Packages: In cases where packages are lost, damaged, or misdelivered, you are required to take immediate steps to investigate and resolve the issue. This may include providing a replacement, offering a refund, or initiating a claim with the transport insurer. NMsize is not responsible for any disputes or claims related to such issues.
Compliance with Shipping Carriers: You must use reliable and compliant shipping carriers that offer consistent service. All shipments must include accurate customs declarations and required documentation to ensure smooth processing at borders.
By agreeing to these shipping terms, you acknowledge your responsibilities as a Creator on NMsize. Failure to comply with any of these terms may result in account suspension, restrictions, or termination.
VIII. PAYMENTS
- Payment Partner: NMsize has partnered with Stripe, Inc. ("Stripe") to facilitate payment processing for transactions between Creators and Customers on the NMsize platform.
- Payment Processing: All payments made by Customers to Creators on NMsize will be processed through Stripe's payment gateway.
- Disbursements: Stripe will disburse funds to Creators' designated bank accounts or debit cards, subject to the terms of Stripe's User Agreement and any applicable laws and regulations.
- Payout Timing: Funds will be automatically transferred to the Creator's account 48 hours after the Customer accept the order.
- Customer Disputes: If a Customer disputes the order or requests a refund within 7 days of marking the order as delivered, the Creator's funds may be held in escrow pending resolution of the dispute.
- Automatic Release: If no action is taken by the Customer within the 7-day period, the funds will be automatically released to the Creator.
Creator Responsibilities
- Express Account by Stripe: Creators are responsible for creating and maintaining a Stripe Express account and providing accurate banking information.
- Payment Information: Creators must ensure that the payment information provided to Stripe is correct and up-to-date.
- Compliance: Creators must comply with all applicable laws and regulations related to payment processing, including but not limited to anti-money laundering and fraud prevention laws.
IX. CREATING AND UPLOADING CONTENT
As a member of NMsize, you have the opportunity to create and upload various types of content, such as listings, messages, text, photos, and videos. To ensure our community remains safe and respectful, you agree not to upload content that:
- Contains hateful or derogatory language or imagery, or any content that violates our Anti-Discrimination and Hate Speech Policy.
- Contains threats, harassment, extortion, or violates our rules about interference.
- Violates someone else’s intellectual property rights.
- Is false, deceptive, or misleading.
- Contains unsolicited advertising or promotions, requests for donations, or spam.
- Contains private information, whether it is your own or someone else’s.
- Encourages or facilitates an off-platform transaction.
- Contains prohibited medical drug claims.
- Sexualizes minors under the age of 18.
- Violates any of the rules described in our Prohibited Items Policy.
Members may not use NMsize services such as messages, favorites, or collections to make inappropriate use of otherwise compliant content, whether overtly or through contextualization. This includes, for example, aggregating content with the intent of sexualizing minors.
X. PRIVACY AND PROTECTING PERSONAL INFORMATION
You are responsible for protecting the personal information of NMsize members that you receive or process, and you must comply with all relevant legal requirements. This includes applicable data protection and privacy laws governing the use of NMsize user information.
When interacting with NMsize users, you may receive and manage certain personal information, such as customer names, email addresses, shipping addresses, and body measurements provided by the customer. This information may only be used for NMsize-related communications or transactions facilitated by NMsize. You must not use this information for unsolicited commercial messages or unauthorized transactions. Without the customer’s explicit consent and in accordance with NMsize policies and applicable laws, you may not add any NMsize member to your email or physical mailing list, use their identity for marketing purposes, or retain any payment information.
If you disclose personal information without proper consent, including body measurements or other sensitive data, you are responsible for that unauthorized disclosure. This includes accidental data breaches. You are also responsible for understanding the required consent standards for any given instance.
In the event that NMsize and you are considered joint data controllers of personal information and NMsize incurs expenses due to actions taken in your capacity as a joint data controller, you agree to indemnify, defend, and hold NMsize (and its employees, agents, consultants, subsidiaries, partners, affiliates, and licensors) harmless against any claims, costs, losses, damages, liabilities, judgments, and expenses (including reasonable attorney fees) related to your processing of customer personal information.
XI. COMMUNICATION STANDARDS
On NMsize, you can use the messaging feature to communicate directly with customers or other NMsize members. This is a valuable tool for answering questions about products or orders.
However, Messages may not be used for the following purposes:
- Sending unsolicited advertising, promotions, donation requests, or spam.
- Harassing or abusing other members, or violating our Anti-Discrimination Policy.
- Contacting someone after they have explicitly requested not to be contacted.
- Interfering with another member’s transaction or business.
- Exchanging personal contact information, financial details, or other data for the purpose of conducting transactions outside of NMsize, including phone numbers, addresses, emails, social media handles, external URLs, money transfer instructions, or QR code
Using Messages to harass or discriminate against other members is strictly prohibited. Messages must not be used to support or promote hatred or violate our Anti-Discrimination Policy. If you receive a Message that violates these guidelines, please report it to us immediately.
If you are unable to complete a transaction, you must notify the customer via Messages and cancel the transaction. If the customer already submitted payment, you must issue a full refund. You are encouraged to keep proof of any refunds in the event a dispute arises.
XII. RETURNS & REFUNDS
NMsize is committed to ensuring that both creators and customers enjoy a fair and transparent experience. Creators are expected to maintain high standards of communication and quality, adhering to the specifications provided by customers. Returns or refunds may be requested by customers only in specific situations, as outlined below.
Creator Responsibility
Creators are accountable for the following cases where a return or refund may be requested:
- Instructions Not Followed: Creators must follow all customer specifications, including design and material.
- Timely Delivery: Creators should inform customers of any delays and ensure on-time delivery.
- Order Accuracy: All items must meet the customer's specific design, color, and measurements.
- Accurate Sizing: Creators must apply customer measurements precisely to prevent incorrect sizing.
- Completeness: Ensure all necessary parts, accessories, and components are included in the shipment.
- Craftsmanship Quality: Products must be free from defects in materials or workmanship, with quality checks performed before shipping.
Response to Refund Requests
When a customer submits a refund request via the 'Request a refund' option on the order page, the creator must respond within seven (7) days. Failure to respond within this timeframe will result in the automatic approval of the refund request. Should the creator require further support, they may contact NMsize’s Resolution Center in the Help Center for guidance.
By adhering to these terms, creators agree to uphold NMsize's standards of quality and customer satisfaction in delivering custom-fit fashion products.
XIII. YOUR CREATOR ACCOUNT AND NMSIZE’S TERMS
To ensure the safety and quality of NMsize and to improve our Services, we may take actions that impact the visibility of your shop, listings, or ads, or affect your payment account. If we detect unusual order activity, if you do not meet our customer service standards, or if we believe your actions or shop could lead to customer disputes, chargebacks, fraud, counterfeiting, or other claims, NMsize may:
- Limit the visibility of your shop or listings
- Place restrictions or reserves on your payment account
- Suspend your NMsize account
These actions are taken in accordance with our Terms of Use and NMsize Payments Policy. When possible and legally permitted, we will communicate relevant information to you about the issue.
NMsize may also limit the visibility of listings or ads to maintain platform safety and service quality. Listings or ads with terms representing prohibited items or those affected by third-party policies may have reduced visibility. Despite this, such listings or ads remain discoverable in search results.
We may update onboarding or authentication processes for creators at our discretion, which may be necessary for account activation or continued access.
If NMsize finds that you, your content, or your use of the Services violate our Terms, we may deactivate your content for some or all users, or suspend or terminate your account (and any associated accounts). Generally, NMsize will notify you of any suspension or termination, unless repeated violations or legal reasons prevent us from doing so.
